  1. Our aim is that you enjoy using our website and that you can place orders with Totes Isotoner (UK) Ltd. via our website – www.totesuk.com – or by calling our Customer Service Team on 01277 636802 and these are referred to as the “Services”.
  2. The Terms & Conditions contained in this document (“Terms & Conditions”) apply to purchases made using these Services.
  3. Throughout these Terms & Conditions the terms “Totes Isotoner (UK) Ltd.”, “we”, “our” and “us” refers to Totes Isotoner (UK) Ltd. (company registered in England, number 1530567).
  4. By using the Services you are indicating your acceptance to be bound by these Terms & Conditions. They form a legal agreement between you and us and can only be amended with our consent. Any purchases you make are subject to these Terms & Conditions.
  5. We reserve the right to change these Terms & Conditions from time to time without prior notice, provided that any such change will not affect any purchases you have made before the change is implemented. Ordering

  1. The display of products on our website is an invitation to treat and not an offer to sell.
  2. For details on how to place an order with Totes Isotoner (UK) Ltd. you should refer to the relevant information at www.totesuk.com. You will have an opportunity to view your order and make any amendments to it up until the point at which you submit your order.
  3. All orders placed by you are an offer made by you and are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. We also reserve the right to close your account for any reason and will not be liable to you or anyone else in those circumstances.
  4. Acceptance of your order and the forming of a contract between us will take place when we despatch the products ordered to you, unless we have notified you that we do not accept your order or you have cancelled it in accordance with sections 25 – 32 below.

Prices

  1. All prices are in pounds (£) sterling, inclusive of UK VAT (where applicable) and are correct at the time of publishing. Prices do, however, exclude delivery charges.
  2. Delivery charges, where applicable, are clearly displayed when you view the products you have selected within your basket. Delivery charges will be added to the total amount due once you have selected a delivery service, upon which they are automatically calculated and added to your order.
  3. Subject to sections 14 and 15 below, the price you pay is the price displayed on the relevant Service at the time we receive your order.
  4. In the unlikely event that the price of a product has been incorrectly advertised, we will contact you to ask whether you wish to proceed with the order at the correct price. If you are not happy to proceed, or we are unable to obtain your instructions, we will cancel the order. We will not be obliged to supply products at the incorrect price.   5. We reserve the right to change prices to meet future changes in VAT legislation.

Payment

  1. Payment can be made using most major credit/debit cards or by cheque. We do not accept cash. Further information on payment methods is available at www.totesuk.com.
  2. We cannot accept your order until you have paid for it in full.

Delivery

  1. We deliver to mainland UK and Northern Ireland (unless otherwise specified). We are also able to deliver to certain other locations. For more information about delivery locations please contact “Customer Services”.
  2. Where delivery charges are displayed on screen, these are standard UK mainland delivery charges only (unless otherwise specified).
  3. All orders will be despatched within three days of your order and cleared payment. Further details of our estimated timescales for delivery are available at www.totesuk.com.
  4. We only despatch products ordered by you once payment has been authorised. If you are paying by cheque, your order will not be despatched until your cheque has arrived and has been cleared.
  5. Once delivered, the products ordered will become your property (provided they have been paid for in full) and your responsibility. Risk for loss and damage to products passes to you on delivery.
  6. If you order products for delivery outside the United Kingdom, they may be subject to import duties and taxes; you will be responsible for these. We have no control over such charges and cannot advise you as to what any such charges may be. Your local customs office should be able to assist. For deliveries outside the United Kingdom you will be considered to be the importer and it is your responsibility to comply with all laws and regulations of the country to which the products are to be delivered. Cross-border deliveries may be opened and inspected by customs authorities.
  7. We are not liable for delays to deliveries which are outside our control.

Returns & Cancellations

  1. Every product sold via these Services is backed by our 14-day money back guarantee (“14-Day Money Back Guarantee”). We want you to be satisfied with your purchase but if you change your mind about a product or would like to change it, please follow the returns procedure enclosed with the product and obtain proof of return to us. You are responsible for the cost of any returns.
  2. Under our 14-Day Money Back Guarantee the purchase price will be refunded provided that both product and product packaging are returned unused and in original condition. You should allow up to 21 days from receipt of your returned product at our Billericay address for your refund to be processed. We will normally refund you using the same payment method that you used to purchase the products. Our delivery charges will not be refunded.
  3. You also have a statutory right to cancel your purchase. If you wish to cancel you must first telephone us and follow this up with confirmation in writing. You should retain proof of having given us notice to cancel, for example, a Certificate of Posting from the Post Office. Both product and product packaging must be returned unused and in original condition.

Faulty or Damaged Products

  1. We will refund the purchase price together with the delivery charge for any product which is delivered in a damaged or faulty condition.
  2. Alternatively, and at our discretion, Totes Isotoner (UK) Ltd. will replace the product with the same, or a similar, product (subject to stock availability). Please follow the returns procedure enclosed with the product. Please obtain, and retain, proof of return to us and allow 21 days from our receipt of your product for your refund to be processed or a replacement product to be despatched.
  3. We reserve the right to refuse to issue a refund/replacement product and to recover the cost of the return delivery from you in the event that the product is found to have suffered damage after delivery or has been misused or used other than in accordance with the instructions or if the problem is as a result of normal wear and tear. We do ask that we are advised of damaged or faulty products as soon as possible and that they are returned to us promptly.

  5. Nothing in this section or elsewhere in these Terms & Conditions or in our returns policy affects your statutory legal rights.

Product Information

  1. We have taken reasonable steps to display as accurately as possible the colours and other detailing relating to our products. We cannot guarantee that the equipment you use to view the products will accurately reflect the colour of or detailing on the product delivered to you.
  2. Any information regarding sizing of products is included as a guide only.

Our Liability

  1. We will not be liable to you where performance of any of our obligations is prevented or restricted by any circumstance or cause beyond our reasonable control.
  2. You are responsible for the use you make of the products you order. To the extent not prohibited by law, we accept no liability for any loss which is not reasonably foreseeable or for any business loss (which includes but is not limited to loss of profits, contracts, goodwill, opportunity and other similar losses).
  3. We accept liability for death or personal injury caused by our negligence that cannot, under English law, be excluded.

  3. Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms & Conditions. If any part of these Terms & Conditions is found to be unenforceable as a matter of law, all other parts of these Terms & Conditions shall be unaffected and shall remain in force.
  4. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of our services shall remain at all times vested in us or our licensors.
  5. You may not assign or sub-contract any of your rights or obligations under these Terms & Conditions or any related order for products to any third party unless agreed upon in writing by Totes Isotoner (UK) Ltd.
  6. Totes Isotoner (UK) Ltd. reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these Terms & Conditions or any related contract to any third party.
  7. No term of any contract subject to these Terms & Conditions shall be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person not a party to such contract.
  8. You agree that English law applies to these Terms & Conditions and that any dispute between us arising out of or in connection with these Terms & Conditions will only be dealt with by the English courts.
  9. Should a product be recalled for any reason, you will be contacted using the information you provided at the time of placing your order.
